Anumiti procurori anticoruptie s-au specializat in a declansa urmariri penale la comanda * ZIUA prezinta azi un caz flagrant de abuz judiciar comis in baza unor plangeri ale lui Stefan Radulescu

ZIUA prezinta un caz flagrant de abuz judiciar comis de DNA, in care se demonstreaza ca anumiti procurori din trupa lui Daniel Marius Morar (foto) deschid abuziv dosare penale, pentru a compromite magistrati si oameni de afaceri, in scopul favorizarii unor personaje certate cu legea acuzate de fraude de zeci de milioane de euro. Este vorba de cunoscutul caz al compromiterii procurorului Constantin Gherta, din Parchetul General si a unor oameni de afaceri, in frunte cu Gheorghe Tofan, impotriva carora in 2005 – 2006 DNA a inceput urmarirea penala, sub acuzatia de santaj, ca urmare a unor plangeri formulate de vestitul afacerist Stefan Radulescu si sotia acestuia Mariana Radulescu.

Procurorul Gherta de la DIICOT, gasit nevinovat de DNA dupa doi ani! (Gardianul)

Dupa ce a stat, timp de doi ani si jumatate, sub ancheta Directiei Nationale Anticoruptie, procurorul Marius Gherta de la DIICOT din cadrul Parchetului Inaltei Curti de Casatie si Justitie a primit solutia de scoatere de sub urmarire penala intr-un dosar dinadins tinut de catre un procuror a carui incompetenta nu mai poate fi sanctionata, pentru ca s-a refugiat, dupa o perioada lunga de asa-zisa boala grava, din DNA in avocatura. E vorba despre Constantin Balcan. Dosarul in care procurorul Gherta a fost anchetat pe sesizarea facuta de Mariana Radulescu, sotia bine-cunoscutului invinuit Stefan Radulescu, putea fi finalizat de multa vreme. Dar aceasta „facatura“ de dosar a zacut la DNA pentru ca, astazi, nimeni sa nu mai stie pe unde a disparut acest personaj imbogatit peste noapte din afacerea „Tofan“.

Prezentam, astazi, rezumatul ordonantei prin care procurorul Gheorghe Bocsan, venit de putina vreme in DNA, care a preluat dosarele ravasite si masluite ale ex-procurorului DNA Balcan, a scos de sub urmarire sau a dat neincepere pentru cele patru persoane urmarite penal de peste doi ani. Inceperea urmaririi penale fata de procur orul Constantin Gherta, Gheorghe Tofan, Mihai Buciu si Dan Nicoara a fost dispusa in 15 noiembrie 2005. Tofan era acuzat ca, in mod repetat, ar fi actionat direct sau prin intermediul lui Buciu, pentru a o constrange pe Mariana Radulescu sa-si determine sotul, pe Stefan Radulescu, sa-i transfere activele firmelor pe care le administra, dar si ca acesta l-ar fi amenintat pe Radulescu, spunand ca are influenta asupra procurorului care-l cerceta. Sub aceleasi acuzatii a intrat si Buciu. Procurorul Gherta a fost cercetat pentru ca ar fi intrat, cu amenintari la adresa sotiei lui Radulescu - persoana pe care o cerceta in dosarul de la Parchetul Inaltei Curti, in acest joc, dar si pentru ca „a ingaduit, cu buna-stiinta invinuitilor Tofan Gheorghe si Buciu Mihai Cristian sa sustina, in fata numitei Radulescu Mariana si a altor persoane, ca detin influenta necesara asupra sa pentru a-l determina ori sa agraveze, ori sa favorizeze situatia numitului Radulescu Stefan, in cauza penala pe care o instrumenta“.Pe parcursul anchetei, au mai fost depuse la dosar plangeri ale unor persoane cu calitati procesuale diferite in cauza.

Din cuprinsul ordonantei reiese ca procurorul nu a proferat nici un fel de amenintari la adresa partii vatamate, cu toate ca Mariana Radulescu isi formase aceasta parere in urma unor discutii avute cu magistratul, unele inregistrate pe sest, dar care au pe alocuri continut neinteligibil.

Gelu Tofan seeks solutions to revive Danubiana

Businessman Gheorghe Tofan, who manages Tofan Grup and Danubiana, one of the leading tyre producers in Romania, says he is trying to attract an American investment fund as a shareholder, after the company's administration process is completed.
The Tofan Grup, one of the largest holdings of the last decade, which, apart from the tyre producer Danubiana, also includes Tofan Trans and Rotras, was placed under administration over a year ago after it cumulated debt worth over 17 million euros.
"We are still under administration, a process which should have ended in December last year. I hope I will be able to finish restructuring the business in the first quarter of this year, and that we can start investments, private funds meant to help develop Danubiana," said Gelu Tofan.
The businessman added the plan was to attract an American investment fund as a shareholder after the completion of the restructuring process, and was working on it with consultants PriceWaterhouseCoopers.
Danubiana is the only producer of bias tyres in the region, with Belarus and Turkey being the other countries where such tyres are produced in Europe. After it sold the Silvania plant in Zalau to Michelin in 2001, Tofan gave up car tyre production to focus exclusively on tyre production for off-road vehicles, trucks, buses, tractors and farming vehicles.
"I have three solutions for the company. One is to move production to China or Belarus," said Tofan.
He added that currently, production of radial tyres was no longer profitable in Romania due to the increased price of utilities, which results in excessively high costs per kilo of tyre produced.
According to Tofan, another solution is to keep production in Romania and make the business profitable by attracting investments. He does not rule out another solution, an alliance with a similar producer in Turkey, in order to set up a regional holding.
Although Tofan predicted the rebound of commercial and manufacturing operations last year, the group's results fell below expectations. In 2006, according to the Ministry of Finance, Danubiana posted business worth 2.3 million euros and losses worth 6.8 million euros.
